BRIER PLANNING COMMISSION MINUTES
October 18, 2006
7:00 PM



Chairman Lavoie called the Brier Planning Commission meeting to order at 7:02 PM.

ROLL CALL:

Present: Commissioners Gene Funk, David Marley, Keith Maw, Scott Warner, Michael Lavoie, and Kerin Steele.

Councilman Krienke, Planning Commission liaison.

Absent: Commissioner Allyn Chrisman

APPROVAL OF MINUTES:

Chairman Lavoie opened for consideration approval of the September 20, 2006 regular Planning Commission Meeting minutes. Commissioner Marley moved and Commissioner Steele seconded to approve the September 20, 2006 regular Planning Commission Meeting minutes. Motion Carried.

COMMITTEE REPORTS:

Commissioner Funk asked about a dead tree on 212th leaning north toward the roadway, who is responsible to bring it down before winter storms. An additional tree in front of Ed Walker's property on south side is leaning into the road as well.

Councilman Krienke informed the Commission that the Council passed the new short subdivision ordinance and Councilman Gipson thanked the Commission for all of their hard work on the ordinance. He gave an overview of the status of the McClenny Meadows subdivision.

PUBLIC REQUESTS & ORAL COMMUNICATIONS: None.

NEW BUSINESS:

PUBLIC HEARING ON LOT LINE ADJUSTMENTS #LL06-001, #LL06-002, #LL06-003, & LL06-004, Chairman Lavoie asked if there were any conflicts of interest with the Commissioners that are present hearing this matter. He then turned the floor over to Jim Cutts, Director of Community Development and Planning who reviewed and discussed the proposed Lot Line Adjustments.

Jim Egge and Lori Quadi were here to represent Phoenix Development and Sunquest Homes. Mr. Egge gave an overview of the proposed adjustments and the intent for the use of these parcels in their future project. Keith Maw had questions for the applicant regarding a PUD easement. James Vaughn 24215 Brier Road, stated that his driveway is an easement shared between him and a neighbor.

Chairman Lavoie opened the public hearing at 7:34 PM.

Ed Walker 21206 Poplar Way asked about a substandard lot. Jim Egge explained the intention for that lot and how it will not be a substandard lot when the Sunbrook subdivision is approved and completed. Mr. Walker stated his support for the adjustment.

James Vaughn 24215 Brier Road, stated that he is giving up a half acre of his property and he recommends that the lot line be approved.

Dan Hart 2724 241st Place, stated that the applicant wants to take his fence down and move it back 3 feet his fence has encroached over the property line by 1.5 feet. He wanted to know if he has to let them take this since his fence has been there since 1986.

Patrick Sibley 2711 241st Place, was concerned that in the interim there is a home being frequented by a youth gang at night. He would like to know how long this process will take before the home will be torn down? Chairman Lavoie stated that things such as the fire codes dictate that the home be boarded up.

Chairman Lavoie closed the public hearing at 7:45 PM.

Commissioner Steele does not a have a problem with the lot line adjustment but she has a problem with the way our code reads.

Commissioner Warner moved and Commissioner Maw seconded to recommend approval of Lot Line adjustment LL06-001. Motion carried.

Commissioner Warner moved and Commissioner Maw seconded to recommend approval of Lot Line adjustment LL06-002. Motion carried.

Commissioner Warner moved and Commissioner Maw seconded to recommend approval of Lot Line adjustment LL06-003. Motion carried.

Commissioner Warner moved and Commissioner Maw seconded to recommend approval of Lot Line adjustment LL06-004. Motion carried.

OLD BUSINESS - CONTINUATION:

DISCUSS TREE PRESERVATION ORDINANCE CHAPTER 18-20.

Chairman Lavoie opened for discussion the tree preservation ordinance. Jim Cutts briefly went over some of the adjustments that have been made and tried to make the ordinance clearer. The Commission had discussion of changes that were made and significant changes to be made. A copy with the revisions will be sent out in the next Planning Commission packet.

Commissioner Maw moved and Commissioner Steele seconded to hold a special meeting on November 1, 2006 to discuss this issue further.

Commissioner Marley moved and Commissioner Steele seconded to adjourn. Meeting adjourned at 9:28 PM.
